FMEW recently won summary judgment dismissing claims for contractual and common law indemnification against our client in a multi-million dollar Labor Law 240(1) action. In dismissing the contractual indemnification claim, the New York County Supreme Court (Hon. J. Gische) held that our client proved that it did not contractually agree to indemnify the tenant of a building. The Court further held that the common law indemnity claim should be dismissed because the evidence established that our client did not exercise supervisory control over the plaintiff's work.
