FMEW recently won summary judgment rejecting a policyholder's claim for professional liability coverage in connection with an
underlying suit involving a real estate sales transaction. In granting summary judgment, the court held that the policy, issued to a
real estate brokerage firm, unambiguously excluded claims involving properties in which any insured has a financial interest.
The evidence established that one of the policyholder's employees held an interest in the company which owned the subject property.
As a result, the court dismissed all claims against the firm's client, including claims for bad faith and punitive damages,
with prejudice.
